What is EthicsPoint?

EthicsPoint is the external and independent service system powered by NAVEX receiving your concern and providing a secure and confidential telephone and web based service for those who wish to raise a concern.

What type of situations should I report?

EthicsPoint is designed for sharing concerns about suspected misconduct within our Company, that is: any violation of laws and regulations, our Code of Conduct and/or the various policies, rules, standards and procedures under which our Company operates. You are also encouraged to seek guidance on ethical dilemmas, provide positive suggestions, or communicate a concern.

Which channels can I use to report?

Our report procedure is flexible and allows you to raise concerns about suspected misconduct through a variety of channels.

  • As a general guideline, the first person to approach when raising a concern is your line manager or supervisor.
  • If you feel that you cannot raise your concern with your line manager, for whatever reason, you should contact the senior manager in your business unit or store,
  • If you feel however you need to raise the issue outside of your immediate working environment, you can contact your company's Compliance Officer or Committee Committee Member.
  • Alternatively you can use EthicsPoint or another helpline (if any) :asics.ethicspoint.com.

Does management really want me to report?

We certainly do. In fact, we need you to report. You know what is going on in our company - both good and bad. You may have initial knowledge of an activity that may be cause for concern. Your reporting can minimize the potential negative impact on the company and our people. Also, offering positive input or reaching out when in doubt or in need of guidance, may help identify issues that can improve corporate culture and performance.

Non-retaliation – How will I be protected if I Speak Up?

Reporting is encouraged and employees who make a report are protected. Please feel confident that you will not suffer for raising concerns in good faith about suspected misconduct. Any form of threat or retaliation will not be tolerated.

Do reports remain confidential?

All reporting is done confidentially. This means that information about your concern will only be shared with a limited number of people on a strict need-to-know basis. Information will only be disclosed outside this small group if we are required to do so by law or an important public interest is at stake. The confidentiality of your report and your identity will be maintained to the extent practicable and permitted by local law.

Is it possible to report anonymously?

In principle, we are obliged to inform the implicated person that a complaint has been filed against him/her, but your identity will not be disclosed. You yourself can help us protect confidentiality by being discreet and not discussing your report with your colleagues or anyone else. You can share your concerns anonymously (where allowed by the laws of your country). We do however encourage you to reveal your identity as it is more difficult, and in some circumstances even impossible, for us to investigate reports that are made anonymously.

Where do these reports go? Who can access them?

Reports are entered directly on the EthicsPoint secure server to prevent any possible breach in security. EthicsPoint makes these reports available only to specific individuals within the company who are charged with evaluating the report, based on the type of violation and location of the incident. Each of these report recipients has had training in keeping these reports in the utmost confidence.

Will my privacy be safeguarded?

Our Company is committed to protecting the privacy of everyone involved. We will do everything reasonable to safeguard personal data from unauthorized access and processing. Any personal data obtained as part of a report will only be used for the purposes explained in this policy or to comply with the law or an important public interest. When can I expect my concern to be dealt with?

If you submit a formal report, you will receive confirmation of receipt within 10 business days with an estimate of how long it will take to handle and investigate your concern.

What can you expect if you make a report?

Our Company takes all reports of possible misconduct seriously. We will act on any legitimate formal report filed anywhere in the world. The report will undergo an initial review, and if necessary, it will be appropriately investigated. All investigations will be conducted carefully, confidentially and professionally. If it is determined that misconduct actually took place, our Company will take appropriate action.

What if it is an emergency?

The report service via EthicsPoint cannot be used for events presenting an immediate threat to life and property. Reports submitted through this service may not receive an immediate response. Please contact your local authorities if you require emergency assistance.

Tips & Best Practices

I am aware of some individuals involved with unethical conduct, but it doesn't affect me. Why should I bother reporting it?

Our company chooses to promote ethical behavior. All unethical conduct, at any level, ultimately hurts the company and all employees, including you. You only have to consider what happened in recent corporate scandals to see the disastrous effects that a seemingly harmless lapse in ethics can have on an otherwise healthy company. So if you know of any incidents of misconduct or ethical violations, consider it your duty to yourself and your coworkers to report it.

I am not sure if what I have observed or heard is a violation of company policy, or involves unethical conduct, but it just does not look right to me. What should I do?

File a report. EthicsPoint can help you prepare and file your report so it can be properly understood. We'd rather you report a situation that turns out to be harmless than let possible unethical behavior go unchecked because you weren't sure.

What if my boss or other managers are involved in a violation? Won’t they get the report and start a cover-up?

The EthicsPoint system and report distribution are designed so that implicated parties are not notified or granted access to reports in which they have been named.

Are these follow-ups on reports as secure as the first one?

All EthicsPoint correspondences are held in the same strict confidence as the initial report, continuing under the umbrella of anonymity.
